Terms of Service
COURIER SERVICE TERMS, LIABILITY DISCLAIMER & LIMITATION OF LIABILITY
By requesting, booking, paying for, or using our courier and delivery services, the customer (“Customer”) agrees to the following terms and conditions.
1. Customer Responsibility
The Customer is responsible for providing accurate delivery addresses, telephone numbers, recipient information, package descriptions, and any special delivery instructions.
The Customer is also responsible for ensuring that all items handed to the courier are properly packaged, sealed, labelled, and suitable for transportation.
2. Prohibited and Restricted Items
We reserve the right to refuse, cancel, or discontinue transportation of any item that we reasonably believe is illegal, dangerous, improperly packaged, prohibited by law, or likely to cause injury or damage to persons or property.
The Customer must not give us any illegal, hazardous, explosive, flammable, stolen, or otherwise prohibited item for delivery.
The Customer remains responsible for any loss, damage, claim, penalty, or expense arising from the Customer's failure to disclose the contents of a package or from providing prohibited or improperly packaged goods, to the extent permitted by law.
3. Delivery Times
Any delivery time or estimated delivery period provided by us is an estimate unless we expressly agree in writing to a guaranteed delivery time.
Delivery may be delayed by circumstances beyond our reasonable control, including traffic, road closures, weather, mechanical problems, accidents, emergencies, acts of God, strikes, civil disturbances, government action, incorrect customer information, recipient unavailability, or other circumstances outside our reasonable control.
We will make reasonable efforts to complete deliveries within the agreed or estimated timeframe.
4. Loss or Damage
We will take reasonable care of packages while they are in our possession.
If a package is lost or damaged while in our custody due to our negligence or failure to exercise reasonable care, the Customer may be entitled to appropriate compensation subject to applicable law and the terms of the particular service.
Our liability shall not be excluded or limited where such exclusion or limitation is prohibited by applicable law.
5. Limitation of Liability
To the maximum extent permitted by Jamaican law, we shall not be liable for indirect, consequential, special, or purely economic losses arising from a delivery, including loss of anticipated profits, business opportunities, or income, except where such liability cannot lawfully be excluded.
Where legally permissible, our liability for a particular delivery shall be limited to the reasonable value of the goods actually lost or damaged, or the applicable compensation limit expressly communicated to and accepted by the Customer before the delivery, whichever is applicable.
Nothing in these terms is intended to exclude or restrict liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, wilful misconduct, or any other liability that cannot legally be excluded or restricted.
6. Customer's Failure to Be Available
If the recipient is unavailable, refuses to accept the package, provides an incorrect address, or otherwise prevents delivery, we may contact the Customer to arrange another delivery attempt.
Additional delivery, waiting, storage, or return charges may apply where these charges were disclosed to the Customer before being incurred.
7. Proof of Delivery
Delivery may be confirmed by a signature, photograph, electronic confirmation, GPS/location information, message confirmation, or other reasonable evidence of delivery.
The Customer authorizes us to retain reasonable delivery records for purposes of confirming and administering the service.
8. Claims
Any claim concerning loss, damage, or non-delivery should be reported to us as soon as reasonably practicable after the expected delivery date.
The Customer may be required to provide reasonable evidence, including the order details, proof of value, photographs of damage, and other information reasonably necessary to investigate the claim.
Nothing in this section removes any legal right or remedy available to the Customer under applicable Jamaican law.
9. Customer Indemnity
To the extent permitted by law, the Customer agrees to compensate us for losses, claims, fines, damages, or reasonable expenses arising from the Customer's unlawful use of our services, fraudulent conduct, misrepresentation of package contents, or delivery of prohibited items.
This provision does not require the Customer to indemnify us for liability arising from our own negligence or breach of contract except to the extent permitted by applicable law.
10. Governing Law
These terms shall be governed by the laws of Jamaica.
Nothing in these terms prevents a Customer from exercising any rights or remedies that cannot legally be waived or restricted.
11. Acceptance of Terms
By booking or using our courier services, the Customer acknowledges that they have had an opportunity to read and understand these terms and agrees to be bound by them to the extent permitted by law.
If any provision of these terms is found to be unlawful, invalid, or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue to apply.
